This publication analyzes the legal framework applicable to the enforcement of arbitral awards rendered in investment arbitration proceedings under the auspices of OHADA, in particular:
- The rules stemming from the Uniform Act on Arbitration and the Arbitration Rules of the Common Court of Justice and Arbitration (CCJA), as amended in 2017 and entered into force in March 2018;
- The mechanisms for enforcing OHADA investment awards, depending on whether enforcement is sought within or outside the OHADA area;
- An overview of national legal instruments and bilateral investment treaties referring to OHADA and the CCJA as a dispute resolution mechanism.
